charge of two districts. At the end of the school year the City Superintendent of Schools may change or continue such assignment as he may deem best for the interest of the districts concerned. District Superintendents, when not so assigned, shall be assigned by the City Superintendent to such other professional duties as he may think proper.

5. He shall report to the Board of Education any case of gross misconduct, insubordination, neglect of duty or general inefficiency on the part of any Associate or District Superintendent.

6. He shall have the supervision and direction of all Directors and Assistant Directors of Special Branches, and shall assign them to such duties as he may think proper. (As amended December 23, 1903.)

7. The District Superintendents shall be under the direction and supervision of the City Superintendent, who shall receive and transmit to the Board of Education reports received from them, on forms and subjects which he shall prescribe. He shall also prescribe what reports the principals shall make.

8. He shall enforce the Compulsory Education Law, shall nominate to the Board of Education attendance officers, and shall direct and supervise such officers in the discharge of their duties.

9. He shall have supervision of the training schools for teachers, and shall enforce the law with regard to these institutions, and the regulations made in pursuance thereof by the State Superintendent of Public Instruction.

10. He shall appoint such clerks as he may deem necessary and as are authorized by the Board of Education, and shall assign them to their various duties. He shall have power to suspend or discharge them for cause, but they shall have the right to appeal to the Board of Education.

11. He shall act as Chairman of the Board of Examiners. He shall prescribe such examinations as the Charter authorizes. He shall cause to be prepared eligible lists of all who pass such examinations. Such lists shall be kept in his office and shall be open to

inspection by members of the Board of Education and by Associate and District Superintendents. (As amended April 12, 1905.)

12. He shall have power, with the consent of the Board of Education, to employ temporarily, when needed, assistants to the Board of Examiners, at rates to be fixed by the Board of Education.

13. He shall visit and examine, or cause to be visited and examined, all the schools of The City of New York, and report to the Board of Education on the educational system of the City and on the condition of any or all the schools thereof.

14. He shall prescribe suitable blanks, forms, registers and regulations for the following purposes:

(a) Reports on the general efficiency of the schools.

(b) Reports showing the results of inspections and examinations of schools and classes made by the District Superintendents and Associate City Superintendents, together with the names of principals and teachers whose work is conspicuously good or seriously deficient. (c) Reports showing the nature and amount of work done in the execution of the Compulsory Education Laws. (d) Special reports from the District Superintendents and

from principals upon the work of teachers holding temporary licenses, and upon those requiring approval as to fitness and merit under Section 1091 of the Charter. (e) Reports on such other matters as the City Superintendent may deem conducive to the proper organization, government and conduct of the schools.

He shall cause such blanks, forms and registers to be transmitted to the persons or officers entrusted with the execution of the matters contained therein.

16. He shall transmit to the Auditor, to the principal, and to the teacher concerned, in each case of appointment, promotion or transfer of any member of the teaching or supervising force, a certificate setting forth the salary schedule under which the teacher shall be paid, the salary year, and the month during which an annual increase in salary shall become due.

17. He shall report to the Board of Education from time to time the results of the inspections made by the District Superintendents.

18. When a principal or teacher has been suspended by a District Superintendent, the City Superintendent shall immediately report such suspension to the Secretary of the Board of Education, who shall thereupon refer the same to the Committee on Elementary Schools. The City Superintendent shall have power to direct a District Superintendent to prefer charges against a principal or against a teacher (either regular or special) for gross misconduct, insubordination, neglect of duty or general inefficiency, and to direct such District Superintendent to suspend such principal or teacher pending trial. (As amended December 11, 1907, and June 10, 1908.)

19. He shall recommend to the Board of Education the retirement of any member of the teaching or supervising staff, including the members of the Board of Examiners, who is mentally or physically incapacitated for the performance of duty and who has been engaged in the work of teaching or school supervision for a period aggregating thirty years, twenty of which have been in the public schools of The City of New York.

20. He shall have power to delegate any of the above-mentioned duties to one or more Associate Superintendents, except those specifically conferred on him by the Charter.

21. Whenever for any cause the number of teachers assigned to a school shall become greater than the number required in such school, the City Superintendent shall have power to assign the teachers in excess to duty in other schools, until such time as they shall have been regularly transferred to vacancies.

22. He shall have power to close temporarily any of the public schools in case of emergency. (This subdivision was adopted December 23, 1902.)

SEC. 40. 1. Except as otherwise provided by law, no person shall be eligible for election as City Superintendent, Associate City

Superintendent, or District Superintendent, who has not one of the following qualifications: (a) Graduation from a college or university recognized by the University of the State of New York, together with at least five years of successful experience in teaching or supervision since graduation; (b) a principal's certificate for any of the Boroughs of The City of New York obtained as a result of examination, together with ten years' successful experience in supervision or teaching. Resignations of the City Superintendent and the Associate City Superintendents shall be made to the Board of Education. Resignations of the District Superintendents and Directors of Special Branches shall be made to the Board of Superintendents, and shall be reported immediately to the Board of Education.

2. Any vacancy in the office of City Superintendent of Schools, Associate City Superintendent, or District Superintendent, caused by death, resignation, or otherwise, shall be filled for the unexpired term.

3. Not less than forty days before the expiration of the term of office of any District Superintendent or any Director or Assistant Director of a Special Branch the Board of Superintendents shall nominate to the Board of Education a successor to such District Superintendent, Director or Assistant Director. (As amended December 23, 1903.)

4. The Associate City Superintendents shall perform such service in connection with the duties of their office as the City Superintendent of Schools may direct.

5. The Board of Superintendents shall meet at least twice in each school month during the year. It shall keep minutes of its meetings, which shall be printed, and a copy thereof shall be mailed to each member of the Board of Education.

6. Subject to the approval of the Board of Education, the Board of Superintendents shall make rules and regulations for the admission of pupils to the schools, for their promotion and graduation, and for their transfer from one school to another.

7. The Board of Superintendents shall recommend to the Board of Education, when necessary or advisable, (a) text-books, apparatus and other scholastic supplies; (b) changes in the grades of schools or classes; (c) the adoption or modification of courses of study.

8. The Board of Superintendents shall, from time to time, issue syllabuses in the various branches taught, which shall be regarded as the minimum amount of work required in such branches.

9. Nominations for appointment of members of the teaching and supervising staff shall be made in accordance with the provisions of Sections 1089 and 1090 of the Charter; and promotions, transfers and assignments to duty shall be made in accordance with the provisions of Sections 1085, 1086, 1088 and 1090 of the Charter. Nominations from the appropriate eligible list made subsequent to February 3, 1902, shall be made in the regular order of the standing of the candidates on said list, provided, however, that the Board of Superintendents may consider for each appointment the three persons whose names are highest on the appropriate eligible list, without regard to the dates on which the names were placed on such list. In submitting to the Board of Education the names of teachers or others taken from the appropriate eligible list for appointment or promotion, the Board of Superintendents shall report specifically as to any and all persons whose names are not taken in regular order from said list, and also the names of any and all persons upon said list who have been passed without being recommended for appointment or promotion. (As amended May 28, 1902, and April 26, 1905.)

10. A principal or teacher declining appointment shall not be again considered for appointment within a period of six months from the date of nomination, unless the Board of Superintendents shall otherwise determine by a unanimous vote. Failure to report for duty within fifteen days after the date upon which the appointment is to take effect shall be considered a declination of the position, which fact shall be stated in the notice of appointment.
